Throughout these Terms, the company is referred to as One Divine or the Provider, any person who accesses or uses the website is referred to as the User, and the individual or legal entity entering into a services contract with One Divine is referred to as the Client.

2. Application of these Terms

By accessing and using the website www.one-divine.com, the User confirms that they have read and understood these Terms and Conditions.

This document governs the use of the website and the general information relating to One Divine's services. It does not replace the individual offer or contract concluded with each Client.

One Divine may update these Terms where legislative or technical changes occur, or where its activity changes. The version applicable to the use of the website is the one published on the date of access.

3. What One Divine offers

One Divine organizes bespoke private events. Depending on the particularities of each project, the services may include consultancy, concept development, planning, coordination and supervision of the event.

The information, concepts and images published on the website are presentational in nature. They do not constitute a binding offer and do not guarantee the availability of any venue, experience or date.

Contacting One Divine by e-mail, telephone or WhatsApp does not entail the conclusion of a contract and does not confirm the booking of a date. The services, deliverables, prices, deadlines and payment terms are established exclusively through the accepted offer and the contract concluded separately with each Client.

4. Who may enter into a contract

One Divine's services may be contracted only by individuals who have reached the age of 18 and have full legal capacity, or by legal entities.

Where the beneficiary of the event is a minor, the contract is concluded with their parent or legal representative, who assumes the capacity of Client.

5. Suppliers, partners and travel services

Certain services associated with an event are provided by venues, catering suppliers, performers, photographers, technical suppliers, specialised security companies and other independent professionals. One Divine selects and coordinates these suppliers as part of its event organisation service, and the allocation of liability between One Divine, the suppliers, the venue and the Client is established in the contract signed with each Client.

One Divine organises events and does not sell package travel within the meaning of Romanian Government Ordinance no. 2/2018. Transport and accommodation are contracted in the name and on behalf of the Client, within the limits of the mandate granted to One Divine under the event organisation contract.

6. Use of the website

The User undertakes to use the website in good faith and to refrain from any action liable to affect its operation, security or content.

The contact form and the other communication channels may be used only for genuine enquiries, made in good faith and relating to One Divine's services.

7. Intellectual property

The trade name One Divine, the logo, the visual identity elements, the texts, the images and the other materials published on the website are owned by ANA BELLE S.R.L. or are used by One Divine under valid licences, assignments or agreements. They are protected by the applicable legislation on copyright, trade marks and other intellectual property rights.

The reproduction, publication, distribution, adaptation or commercial use of these materials, in whole or in part, without the prior written consent of the rights holder, is prohibited.

8. Protection of personal data

One Divine processes Users' personal data in compliance with Regulation (EU) 2016/679 (GDPR) and the applicable national legislation.

Details of the categories of data, the purposes of processing, the legal bases, the storage periods and the rights of data subjects are set out in the Privacy Policy and the Cookie Policy, published separately on the website.

9. Complaints and dispute resolution

Any notification or complaint concerning the website or One Divine's services may be sent to contact@one-divine.com. One Divine will review the request and provide a response within a reasonable time, as a rule no later than 30 calendar days from receipt of all the necessary information.

Consumers may contact the Romanian National Authority for Consumer Protection (ANPC) - anpc.ro - and may use the Alternative Dispute Resolution (ADR) mechanism made available by ANPC.

The official ADR icon associated with the electronic platform made available by ANPC will be displayed separately on the website.

10. Governing law

These Terms and the legal relationships arising from the use of the website are governed by Romanian law and the applicable rules of the European Union.

For contracts concluded with consumers, the choice of Romanian law does not affect the protection afforded to the consumer by the mandatory provisions of the law that would be applicable in the absence of that choice, under Regulation (EC) no. 593/2008 on the law applicable to contractual obligations.

11. Relationship between the applicable documents

These Terms and Conditions govern access to and use of the website www.one-divine.com.

The services contracted by a Client are governed by the accepted offer, the individual contract and its annexes. In the event of any discrepancy between the general presentation on the website and the individual contract, the individual contract prevails in respect of the contracted services, subject to the applicable mandatory legal provisions.

The processing of personal data is governed separately by the Privacy Policy, and the use of cookies and similar technologies is described in the Cookie Policy.

No provision of these Terms or of the contractual documents limits the rights of data subjects or the consumer rights recognized by mandatory legal provisions.
